Terms of Service

Effective date: September 19, 2026 · Last updated: October 1, 2026

These Terms of Service (“Terms”) are the agreement between you and Note by Note with Mikayla (the “Studio,” “we,” “us”), a private piano studio in New Jersey. They cover this website and, if you enroll, ongoing lessons.

If the student is under 18, you must be the parent or legal guardian. You enter this agreement on your own behalf and on behalf of the student. New Jersey law generally lets a minor disaffirm a contract; that is why the adult is the contracting party.

1. Agreement

By using this website, submitting a first lesson request, or paying for a lesson, you agree to these Terms. If you do not agree, do not use the site and do not enroll.

Our pricing page says we have “no contracts.” That means we do not require a school-year or multi-month commitment. These Terms still apply. They are the house rules, not a lock-in.

2. This website is for information and inquiries

The site describes the studio, 30-minute and 1-hour classes, pricing, and how to request a free first lesson. Submitting the booking form is a request, not a paid checkout and not a guaranteed slot. We will confirm a first lesson time separately by phone, text, or email.

We may change rates, class descriptions, or availability. The rate that applies to your lessons is the rate we confirmed with you in writing before enrollment.

You may not misuse the site (scraping at a volume that harms the host, posting malware, impersonating us, or harvesting emails). We may refuse or cancel a request that appears fraudulent or unsafe.

Content on the site (text, photos, video, lesson descriptions, and branding) is owned by the Studio or used with permission. You may share a page link. You may not copy lesson materials for a competing studio or remove our name from them.

3. First lessons

Your first lesson is currently offered at $0, with no obligation to enroll. A first lesson is typically 30–60 minutes and may include a short consultation. Availability is limited. We may decline or reschedule a first lesson.

If you cancel a first lesson, please give us at least 24 hours’ notice when you can. Repeated no-shows may mean we will not book another first lesson.

4. Tuition and payment

Contact Mikayla for current home lesson rates. We will confirm your rate, payment timing, and cancellation terms in writing (email or text) before enrollment for the class length you choose (30 minutes or 1 hour).

We do not collect card numbers on this website. Pay in person, by check, or by Venmo (or another method we agree to). Venmo is a third party; their terms apply to the transfer.

Contact Mikayla about rates for siblings.

Returned checks or failed Venmo payments may pause scheduling until the balance is current. We do not add surprise fees; if a bank charges us a returned-check fee, we may pass through that actual fee.

5. Scheduling, cancellation, and makeups

Lessons are 30 minutes or 1 hour, as agreed for the student. Cadence is weekly or bi-weekly as we agree.

Makeups. If you need to miss a lesson, give us at least 24 hours’ notice. You may then book a makeup within 30 days, subject to the instructor’s availability. Lessons missed with less than 24 hours’ notice, or unused makeups after 30 days, are forfeited. This matches the policy on our pricing page.

If the instructor must cancel, we will offer a makeup or a credit toward a future lesson, at our option.

You may request a standing time change at the start of a month, subject to availability.

6. Ending lessons

Either you or the Studio may end lessons by notice (email or text is enough). Notice requirements and any applicable refund terms will be confirmed in writing before enrollment.

We may end lessons immediately if a student or adult’s conduct is unsafe, abusive, or repeatedly violates these Terms, or if tuition remains unpaid after notice.

7. Studio rules, materials, and intellectual property

Students and accompanying adults should arrive on time, follow reasonable studio directions, and treat the instrument, the space, and other families with care. A parent of a young child should remain available as we agree for that student’s age and needs.

Practice assignments, method books we lend, and written studio plans remain Studio intellectual property or the publisher’s. The student may keep their own notes and recordings of their playing for personal, non-commercial use. Do not photocopy method books we lend in a way that violates the publisher’s copyright.

You are responsible for getting the student to and from lessons. We do not provide childcare outside the lesson time.

8. Photographs and video

We use a student’s identifiable image or voice on the website or social media only with parent or guardian consent (or the student’s consent if 18+), as described in the Privacy Policy. You may withdraw consent for future use at any time.

9. Phone, text, and email

By giving us a number or email, you agree we may contact you about scheduling, makeups, tuition, and studio updates. That is not consent to unrelated marketing from third parties. Reply STOP to opt out of non-transactional texts. Standard carrier rates may apply.

10. Assumption of risk and limit of liability

Piano lessons are ordinary instructional activities. There is some risk of minor injury (for example, a slip in the studio) or of lost or damaged personal property you bring. You agree to use reasonable care and to tell us about a condition that needs accommodation.

To the maximum extent New Jersey law allows, the Studio’s total liability to you for claims arising out of the website or lessons is limited to the tuition you actually paid us in the three (3) months before the claim.

This limit does not apply to our gross negligence or willful misconduct, to liability that New Jersey law does not allow a business to limit, or to any right you have under the New Jersey Consumer Fraud Act or the Truth-in-Consumer Contract, Warranty and Notice Act. We do not ask you to waive those rights.

The website is provided “as is.” We do not warrant that it will be uninterrupted or error-free. Lesson outcomes (progress, recitals, confidence) depend on practice and vary by student; we do not guarantee a particular result.

You will indemnify the Studio against third-party claims that arise from your misuse of the site or from a guest you bring, except to the extent caused by our gross negligence or willful misconduct.

11. Third-party services

Links to Instagram, Facebook, Venmo, or maps are for convenience. Their terms and privacy policies govern those services. We are not responsible for their content or outages.

12. New Jersey law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules that would choose another state’s law.

You and the Studio agree that the state courts of New Jersey have exclusive jurisdiction over disputes arising out of these Terms, the website, or lessons, except that either party may still use small-claims court if the claim fits. We do not require arbitration and we do not require you to waive a class action where New Jersey law would not allow that waiver.

If a court finds a provision unenforceable, the rest of the Terms stay in effect. A provision that would violate TCCWNA or another non-waivable NJ consumer protection is unenforceable to that extent only.

13. Changes to these Terms

We may update these Terms. The “Last updated” date will change. For a material change to tuition, makeup, or cancellation rules that affects an enrolled family, we will give notice by email or text before the change applies to the next billing period. Continued enrollment after that date is acceptance of the update. Website-only changes (how the form works, for example) apply when posted.

These Terms, the Privacy Policy, and any rate we confirm to you in writing are the entire agreement about the website and lessons. They replace prior oral discussions.
